SUMMARY:

Under the direction of the Assistant Deputy Chief Diversity Officer, EEO Compliance, the incumbent will conduct prompt and thorough investigations of Equal Employment Opportunity (“EEO”) complaints filed by applicants and employees of MTA HQ and MTA Capital Construction (“CC”). Gather, organize and evaluate data from various sources, utilizing research methods and interviewing skills to compile investigative reports. The incumbent will also be responsible for coordinating, developing and monitoring MTA HQ and MTA CC, EEO Program in accordance with applicable laws, regulations and established policies and procedures.

Based on EEO laws, regulations and established policies and procedures, the incumbent will assist the Assistant Deputy Chief Diversity Officer, EEO Compliance with planning, organizing and conducting ongoing anti-harassment, diversity, and EEO training programs to eliminate discrimination and reduce agency liability.

This position supports the Assistant Deputy Chief Diversity Officer, EEO Compliance by developing and monitoring internal, state, and federal statistical analysis and reporting processes to identify any areas that show adverse impact or underutilization for MTA wide. (i.e., MTA wide workforce composition reports, quarterly reports, Diversity Committee Report, EEO Programs, Progress Against Goals report) as well as serves as the primary delegate for concurrence on all hires and promotions within MTA HQ.

The incumbent supports the Assistant Deputy Chief Diversity Officer, EEO Compliance by coordinating and executing internal and external diversity communications and outreach events including diversity recruitment events.

RESPONSIBILITIES:

Primarily responsible for providing counsel, advice and assistance to employees and applicants concerning EEO claims and allegations for discrimination and harassment.

Conduct confidential and sensitive investigations of EEO complaints of discrimination and harassment in a thorough and timely manner as assigned. Track the status of discrimination complaints in process.

Prepare case log of all related investigative activities.

Conduct thorough, probing, detailed interviews with appropriate individuals that may have knowledge of the alleged violation of EEO laws, regulations, policies and procedures; and prepare interview notes.

Research and secure requisite documentation to prove or disprove allegations and complaints made.

Conduct thorough analysis of all evidence gathered in accordance with applicable EEO laws, regulations, and established internal policies and procedures.

Prepare a succinct and thorough written investigative report containing interviews, evidence gathered, and related analysis of applicable EEO policies and procedures.

Maintain case file including investigative summaries on procedures followed, interview reports, documentation on evidence and policies and witness list.

Develop recommendations for final resolution based upon objective review of the investigative file.

Prepare draft determination letters as appropriate and consistent with recommended findings.

Conduct pre-determination settlement discussions and negotiations, as necessary.

Coordinate investigations with Law Department, Labor Relations, Inspector General’s Office, etc., as appropriate, in a manner as to limit the exposure to legal liability for the authority.

Develop and draft recommendations memoranda regarding remedial action(s) and policy changes as remuneration to employee and/or applicant to avoid future allegations of discrimination/unfairness.

Work conjunctively with Assistant Deputy Chief Diversity Officer, EEO Compliance in ensuring timely intervention of departmental staff in dispute resolution and other adverse employee related actions; coordinate with agency Human Resources and General Counsel staff to ensure timely and appropriate actions

Serves as back-up staff for Title VI Manager of Compliance

Manage and conduct employee training sessions for Employee Orientation and Employee Awareness programs addressing EEO policies and topics, complaints processes/procedures and investigatory processes.

Prepares and reviews extensive quarterly and ad hoc statistical and analytical reports and presentations for MTA’s workforce composition, with a particular emphasis on areas in which minorities and women are underrepresented.

Work conjunctively with Assistant Deputy Chief Diversity Officer, EEO Compliance in compiling statistical data and information for MTA HQ and MTA CC in preparation of state and federal reports and records.

Assists the Assistant Deputy Chief Diversity Officer, EEO Compliance with conducting trends analysis in EEO and partnering with HR to develop appropriate action to address areas of concern.

Assist the Assistant Deputy Chief Diversity Officer, EEO Compliance with the preparation and evaluation of MTA HQ, and MTA CC annual EEO programs.

Conjunctively with Assistant Deputy Chief Diversity Officer, EEO Compliance and Human Resources, assist in reviewing job postings of MTA HQ and MTA CC and participate in recruitment planning to address underrepresentation of females and minorities within the posted positions.

Work conjunctively with Assistant Deputy Chief Diversity Officer, EEO Compliance in the identification and analysis of areas of underutilization of protected class members, establish goals, timetables, and strategies for meeting them.

Assist in the evaluation and compilation of documentation in preparation of meetings with employees, supervisors, executive staff, external transportation agencies and MTA Board members to explain the EEO Program and respond to inquiries.

Under the direction of the Chief Diversity Officer and the Assistant Deputy Chief Diversity Officer, EEO Compliance manage the MTA Diversity Council, including the planning and organizing of the events, event logistics, speaker selection and relationship management, as well as program implementation, to promote cultural awareness amongst MTA employees.

Work conjunctively with Assistant Deputy Chief Diversity Officer, EEO Compliance in the review of relevant policies, procedures and practices to identify potential disparities relative to compliance with EEO regulations; make appropriate recommendations for actions to resolve any identified issues.

Assist with the development of required training including, Anti-harassment, Diversity and EEO training curriculum.

Conduct review of MTA HQ and MTA CC facilities to ensure compliance with federal, state, and local EEO regulations regarding posting of EEO Policy Statements.

Maintain cooperative working relationships with MTA and its constituent agencies EEO managerial/senior/executive staff in the development of EEO-related reports.

Work with EEO Managers/Executive Directors at MTA and its constituent agencies to analyze and address EEO-related concerns and meet with affected supervisors and program managers to advise them, accordingly.

Maintain, track, monitor and analyze MTA wide EEO statistical related data generated by the department.

Review current employment policies, practices, and personnel actions to ensure compliance with regulations.

KNOWLEDGE, SKILLS, AND ABILITIES:

The incumbent must have an in-depth and current knowledge of various Federal, State and Local anti-discrimination laws, regulations and executive orders.

Must have an understanding and knowledge of related prerequisites, research techniques and statistical procedures required to prepare EEO-related reports.

Knowledge and demonstrated ability in developing, coordinating and producing EEO-related reports to meet federal and state mandates.

Understanding of EEO reporting requirements.

Ability to analyze and interpret information and/or data and convert it into written investigative reports.

Demonstrated negotiation, organization and problem-solving skills.

Ability to function under limited supervision with minimal direction to achieve established goals.

Ability to prioritize work assignments.

Demonstrated proficiency in the use of Microsoft Office.

Excellent verbal and written communication skills.

Ability to effectively interact with individuals of various backgrounds and cultures.

Must stay up to date on current EEO requirements, laws and regulations.

Requires excellent communication, interpersonal and listening skills.

Must have the ability to multi-task.

Must have demonstrated computer skills.

EDUCATION AND EXPERIENCE:

A Bachelor’s Degree (or equivalent), plus a minimum of 5-7 years of non-clerical experience in Human Resources, EEO or Law.

Prior investigatory interviewing experience and evidence collection required.

Curriculum development and training facilitation experience, a plus
